Four Eligibility Requirements Under 29 USC 2611
An employee is "eligible" for FMLA leave only if all four requirements are satisfied. Miss one and the leave is not protected.

Employed by a covered employer.
Private employers with 50+ employees in 20+ workweeks in the current or preceding year. Public agencies and schools without the 50-employee threshold.

Employed for at least 12 months by that employer.
Need not be consecutive. Breaks of 7+ years generally do not count, with limited exceptions for military service and written agreement.

Worked at least 1,250 hours during the 12 months immediately preceding the leave.
Counted under FLSA principles. Paid leave, holidays, and vacation generally do NOT count toward the 1,250 hours.

Employed at a worksite where the employer has 50 or more employees within 75 miles of that worksite.
Measured as a radius around the worksite, not the employer overall. A small rural branch of a large employer can flunk this test.
